Terms of Service

These Terms apply to all products, websites, applications, and services that link to or incorporate these Terms, including without limitation: the Home Feed, Emergencies, Local Issues, Public Alerts, GeoDrop, My People, Maps and location-dependent ranking and presentation, routing and directions integrations provided by third parties, community reporting, geo-tagged videos, and other social, civic, or location-augmented experiences offered under the GeoKiks brand (collectively, the “Services”).

GeoKiks may deploy the Services through native applications (including iOS and Android), responsive web experiences, embedded experiences, and future distribution channels. Certain features may be available only in specific regions, app versions, or product surfaces; where a feature is unavailable, these Terms still govern your overall use of the Services to the extent permitted by law.

Where additional product-specific terms, store terms, or supplemental policies apply (including Apple App Store or Google Play distribution terms for mobile apps), those terms are incorporated by reference to the extent they do not conflict with applicable law and are not otherwise superseded by these Terms.

By accessing or using the Services, creating an account, or continuing to use the Services after notice of changes, you agree to be bound by these Terms and our Privacy Policy, Cookie Policy, Community Guidelines, and other policies referenced herein.

If you use the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” includes that entity. GeoKiks may refuse service, close accounts, or limit functionality where permitted by law.

We may modify these Terms from time to time. When we do, we will update the “Last updated” date on the Legal Center and, where appropriate, provide additional notice (such as in-app notification or email). Your continued use after the effective date constitutes acceptance of the revised Terms, except where applicable law requires express consent for certain processing activities or contractual changes.

You must be at least the minimum age required in your country or region to enter into a binding agreement and to use social media services without parental consent, or, if higher, at least 13 years of age (or such other age as may be required locally). If you are not old enough, you must not create an account or use the Services.

If you are a minor where local law requires verifiable parental or guardian consent for online services, you represent that such consent has been obtained where required. GeoKiks is not intended for children under the minimum legal age applicable to you, and we do not knowingly offer age-inappropriate experiences to such users.

You represent that the information you provide about your age and account details is accurate, and you will not circumvent age controls using false information, third-party accounts, or deceptive practices.

You agree to provide accurate, current, and complete registration information and to update it as needed. You must safeguard passwords, one-time codes, device access, and recovery methods. You are responsible for activity that occurs under your credentials unless applicable law requires otherwise.

GeoKiks may take actions to maintain platform integrity, including reclaiming usernames that are misleading, inactive for extended periods where permitted, infringing, or required by policy or law. We may offer account security features; use of those features remains subject to these Terms.

GeoKiks may suspend, restrict, or terminate accounts where we reasonably believe there is a Terms violation, security risk, fraud, or legal obligation. You may delete your account where the product permits; certain records may be retained as described in our Privacy Policy and applicable law.

You agree to comply with all applicable laws and regulations in your jurisdiction, including those relating to privacy, publicity, location recording, harassment, civic emergencies, and content distribution.

You agree to follow GeoKiks Community Guidelines and safety notices. You must not misuse the Services, including by distributing malware, probing or bypassing security, attempting unauthorized access, or interfering with users or infrastructure.

You must not use the Services to generate or duplicate inauthentic engagement, manipulate discovery systems in deceptive ways, or degrade the experience of others. GeoKiks may throttle, demote, or block activities that risk platform stability.

You retain any ownership rights in content you submit (“User Content”), subject to the license below and applicable law. You represent that you have the rights needed to grant the license and that your User Content does not violate third-party rights.

You grant GeoKiks a worldwide, non-exclusive, royalty-free, sublicensable, transferable license (to the extent permitted by law) to host, store, reproduce, process, adapt, modify, translate, create derivative works from (such as transcripts or previews), publish, distribute, publicly display, publicly perform, communicate to the public, and otherwise use User Content in connection with operating, improving, promoting, analyzing, and securing the Services, including ranking, recommendations, moderation, safety detection, aggregation, and product development. To the extent required by law in your jurisdiction, certain categories of processing may rely on separate legal bases as described in our Privacy Policy.

You understand that User Content may be processed by automated systems and human reviewers for enforcement, trust and safety, anti-abuse, spam prevention, integrity of civic and emergency-related features, and measurement. GeoKiks may remove or restrict User Content where required by law or policy.

The Services may associate User Content with location context, including coordinates, place names, or inferred areas based on device signals. Location presentation may vary by feature (for example, map surfaces, proximity rankings, or crisis-related displays).

You should avoid posting sensitive personal locations (such as private residences, schools, or workplaces of identifiable individuals) without lawful authority and appropriate consent. Do not use the Services to direct harm, facilitate stalking, or enable harassment using location data.

GeoKiks may use location-related signals to rank, filter, verify (where feasible), and present content consistent with product design and safety priorities. Accuracy and availability of location signals vary by device, OS permissions, connectivity, and environmental factors.

Location information may be inaccurate, delayed, or unavailable, including due to GPS error, indoor environments, spoofing, OS limitations, or user settings. GeoKiks does not warrant the accuracy of any map pin, distance estimate, or suggested proximity.

Features such as My People or similar trusted-connection experiences may depend on mutual consent, explicit settings, and in-product invitations where applicable. You must not use these features to stalk, harass, control, or monitor another person without permission where such conduct is unlawful.

GeoKiks is not a personal safety guarantee, panic-button service, or emergency response provider based solely on location sharing within the app. Always contact official emergency services when you are in danger.

The Services may present user-initiated reports, official or publicly sourced alerts, and community-sourced information concerning emergencies, civic events, hazards, or weather. Such information may be incomplete, delayed, mislabeled, or later revised by authorities.

GeoKiks is informational and does not serve as a replacement for 911, 112, 999, or other official emergency dispatch or government alert systems. If you believe you are in imminent danger, contact emergency services immediately and follow instructions from qualified responders.

You must not knowingly post false emergencies, misrepresent severity, or interfere with incident response. GeoKiks may remove content, add warnings, or cooperate with authorities where legally required.

The Services may integrate or link to mapping, routing, or directions capabilities provided by third-party providers, operating systems, or browser capabilities. Routes, travel times, road closures, and hazard information may be inaccurate or stale. Conditions change in real time.

GeoKiks is not a dedicated navigation provider and does not replace onboard vehicle navigation, official roadway signage, or professional guidance for hazardous conditions. You agree to obey applicable traffic laws and use independent judgment.

Do not rely on GeoKiks for emergency evacuation decisions alone. Follow instructions from governmental authorities and public safety agencies when available.

You agree not to use the Services to: (a) submit false emergency reports or manipulate public concern; (b) threaten, glorify, or coordinate violence; (c) engage in hate, harassment, or coordinated bullying; (d) dox or publish others’ sensitive private information unlawfully; (e) facilitate stalking; (f) exploit or endanger children; (g) promote terrorism or serious criminal activity; (h) operate scams or deceptive financial schemes; (i) distribute malware, scrape the Services in violation of these Terms, or reverse engineer except as permitted by law; (j) impersonate people or organizations in a misleading or harmful manner; or (k) conduct spam or inauthentic amplification.

You agree not to interfere with or disrupt the Services, attempt to bypass rate limits or access controls, or misuse automated means to collect data from the Services except through documented interfaces where expressly permitted.

GeoKiks may investigate violations using automated and manual techniques, preserve relevant records, and cooperate with law enforcement as required or permitted by law.

GeoKiks may take moderation actions including removing or restricting content, labeling content, limiting distribution, disabling features, suspending or terminating accounts, and applying account or device restrictions consistent with our policies.

Enforcement may rely on user reports, automated classifiers, operational rules, and human review. Decisions may be imperfect; where appeals are offered for a decision, follow the mechanisms described in our Content Moderation & Appeals Policy.

Nothing in these Terms obligates GeoKiks to monitor all content. GeoKiks may however review content where appropriate for safety, legal compliance, or product integrity.

The Services, including software, visual design, logos, layouts, documentation, and related materials, are protected by intellectual property laws. Except for the license to User Content granted by you, GeoKiks and its licensors retain all rights.

You may not use GeoKiks trademarks, trade dress, or branding in a manner that implies endorsement, partnership, or sponsorship without prior written permission, except as allowed by descriptive fair use or law.

If you submit suggestions, feedback, or ideas (“Feedback”), you grant GeoKiks an unrestricted, perpetual, irrevocable license to use Feedback without obligation to you, except where prohibited by law.

GeoKiks respects intellectual property rights and expects users to do the same. For claims of copyright infringement, please follow our Copyright & DMCA Policy, which describes notice requirements, counter-notification, and repeat infringer handling.

Designated agent and filing details are listed in that policy. Submitting materially false claims may expose you to liability under applicable law.

Our Privacy Policy explains how we collect, use, share, and retain information, including location-related data, device data, and content. Where these Terms and the Privacy Policy address the same topic, both apply as described, subject to applicable law.

GeoKiks seeks to align its practices with applicable privacy and safety laws, but your rights may vary depending on your country, state, or region.

GeoKiks may display advertisements or sponsored placements. Advertisers are responsible for their ad content subject to our policies. Interactive ads may link to third-party destinations governed by their own terms.

Mobile apps may integrate third-party modules (such as advertising measurement, maps, analytics, or content delivery networks). Those providers may process data under their own policies and terms. Apple, Google, mapping providers, and other platforms may impose additional requirements.

To the extent permitted by law, GeoKiks is not responsible for third-party services you access via links or embedded features.

If you download GeoKiks from the Apple App Store, you acknowledge that Apple is not a party to these Terms and that Apple has no maintenance or support obligation for the app beyond what Apple requires. Apple’s applicable store terms may apply.

If you download GeoKiks from Google Play, Google’s applicable terms for users and developers may apply in addition to these Terms.

In the event of conflict between these Terms and mandatory store terms of a platform provider, the platform terms govern solely with respect to that provider’s distribution obligations, to the extent required.

GeoKiks may modify, suspend, or discontinue features or products, introduce beta experiences, or merge offerings where legally permitted. We will provide notice where required by law.

The Services may experience interruptions, maintenance windows, degraded performance, or outages. GeoKiks does not guarantee continuous, error-free, or secure operation. You acknowledge reliance on networks and devices outside GeoKiks’ control.

GeoKiks may suspend or terminate your access where reasonably necessary to address Terms violations, legal risk, harm prevention, security incidents, fraud, or coercion by lawful process, subject to applicable law and our policies.

GeoKiks may reclaim or close accounts that remain inactive for extended periods where permitted after notice when required. You may lose access to content upon closure; export options may be offered as described in product settings or privacy rights flows.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

GeoKiks DOES NOT WARRANT THAT ALERTS, MAPS, DIRECTIONS, LOCATION ESTIMATES, OR USER REPORTS ARE ACCURATE, COMPLETE, OR TIMELY. YOU ASSUME ALL RISK FROM RELIANCE ON SUCH INFORMATION.

Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply only to the fullest extent permitted.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GeoKiks BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GeoKiks’ AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID GeoKiks FOR THE SERVICES (IF ANY) IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) WHERE NO FEES APPLIED, SUBJECT TO LOCAL CONSUMER RULES.

These limitations apply to claims related to missed alerts, inaccurate location, routing errors, user content, downtime, data loss, third-party services, and similar matters. Nothing in these Terms limits liability that cannot be limited under applicable law (such as gross negligence or willful misconduct, where applicable).

To the extent permitted by law, you agree to indemnify, defend, and hold harmless GeoKiks and its affiliates, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your User Content; (b) your use of the Services; (c) your violation of these Terms or applicable law; or (d) your violation of third-party rights.

GeoKiks may assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate. This indemnity does not apply to the extent prohibited by law.

Subject to mandatory consumer protections, governing law, venue, arbitration, and class-action waiver rules may be specified in a separate dispute resolution addendum published in the Legal Center or presented at account creation where required by law.

Some jurisdictions do not allow mandatory arbitration or class-action waivers, so this Section may not apply to you. Nothing in these Terms limits non-waivable rights you may have under local consumer law.

You and GeoKiks agree that courts of competent jurisdiction may grant equitable relief necessary to protect rights pending arbitration or where arbitration is unavailable.

GeoKiks operates globally where permitted. Laws differ across countries regarding privacy, speech, emergencies, mapping, exports, sanctions, and minors. You are solely responsible for ensuring that your use of the Services is lawful where you live or travel.

If you access the Services from outside the United States, you consent to cross-border processing and storage of information as described in our Privacy Policy, subject to required safeguards.

GeoKiks may update these Terms to reflect product, safety, regulatory, or operational changes. Material changes will be communicated as required by law, including updating the Legal Center and, where appropriate, providing additional notice in-product or by email.

If you do not agree to revised Terms, you must stop using the Services and, where available, delete your account.
