Welcome to Geokiks — a platform to create, explore, and share short videos based on your location and travel journey. These Terms of Use ("Terms") govern your access to and use of the Geokiks mobile app and services ("Service"). By using Geokiks, you agree to these Terms. If you do not agree, please don’t use the app.

1. Who May Use the Services

You must be at least 13 years old (or the minimum age required by law in your jurisdiction). If you're under 18, you must have consent from your parent or legal guardian.

By creating an account, you confirm that:

• You are eligible to use Geokiks.
• The information you provide is accurate and up to date.
• You will comply with all laws and regulations while using the Service.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our community guidelines.
• We suspect fraudulent or unauthorized use.

3. User Content

a. Ownership

You own the content (videos, comments, images, etc.) you create and post on Geokiks.

b. License to Geokiks

By uploading content, you grant Geokiks a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, host, reproduce, distribute, publicly display, adapt, and promote your content in connection with the Services.

This license ends when you delete your content or account unless your content has been shared, reposted, or stored as part of legal or operational requirements.

c. Your Responsibilities

You are solely responsible for your content. You agree not to post:

• Content that infringes on copyrights or privacy rights.
• Hateful, harassing, violent, or illegal material.
• Misinformation or harmful content that could mislead or endanger others.

4. Location-Based Features

Geokiks uses location services to:

• Tag videos with geolocation metadata.
• Enable features like Story Maps and Route Map Videos.

You control location permissions in your device settings. If disabled, certain features may not be available.

5. Prohibited Conduct

You may not:

• Use the Services for illegal or unauthorized purposes.
• Harass, impersonate, or intimidate others.
• Attempt to interfere with the platform’s integrity or security.
• Use bots, scrapers, or automated tools to collect data.

6. Intellectual Property

All Geokiks branding, design, and software are owned by Geokiks Inc. You may not copy, distribute, or reverse-engineer any part of our platform.

7. Suspension and Termination

We may suspend or terminate your account or access to the Service without notice if you:

• Violate these Terms or our policies.
• Create risk or legal exposure for us or other users.

You may also terminate your account at any time by deleting it through the app or contacting support.

8. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free service. Your use of the platform is at your own risk.

9. Limitation of Liability

To the maximum extent allowed by law, Geokiks Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of your use or inability to use the Services.

10. Indemnification

You agree to defend, indemnify, and hold harmless Geokiks Inc., its affiliates, officers, and employees from any claims, damages, or legal proceedings resulting from your use of the Services or violation of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state or federal courts located in Cook County, Illinois for any disputes arising out of or relating to these Terms or the Services.

12. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you in the app or by other means. Continued use of Geokiks after the changes means you accept the updated Terms.
